Terms of Service

1. Your account

You must be at least 18 and give accurate details. You’re responsible for what happens under your account and for keeping your sign-in secure. New accounts get free preview credits; downloading results needs a paid plan.

If you connect Propviz to an AI assistant, such as ChatGPT or Claude, you’re responsible for what it does in Propviz on your behalf, including the credits it spends with your approval.

2. Credits, plans and payment

Each generation uses credits at the rates on our pricing page, and the studio shows the cost before you generate. You’re only charged for results that are created and saved: failed attempts are free.

Pro renews monthly until you cancel, and you can cancel renewal in billing settings at any time. Your plan stays active until the end of the period you’ve paid for. Monthly credits reset each billing period and don’t roll over. Sign-up credits and purchased top-up credits don’t expire while your account is open. Top-ups need an active paid plan. Credits have no cash value and can’t be transferred or exchanged for money.

If you’re a consumer in the EU or UK, you can cancel a purchase within 14 days of making it, without giving a reason, by emailing hello@propviz.ai. When you pay, you ask us to make your credits available straight away, so if you cancel we’ll refund what you paid, less the value of any credits you’ve already used. Apart from this, and except where the law says otherwise, payments aren’t refundable and we don’t refund partial months. If you think a charge is wrong, email us.

We’ll give you at least 30 days’ notice of a price change, and it applies from your next billing period.

3. Your content

You own the photos, drawings and listing details you upload. Results you download on a paid plan are yours to use for any lawful purpose, including in listings, ads, presentations and client work, and that continues after your plan ends. You let us store and process your uploads and results so we can provide Propviz to you, including sending them to the AI providers that create your results.

Only upload photos, drawings and listings you have the right to use, such as photos you took, photos you’ve licensed, or a listing you’re authorised to market. Listing photos often belong to the photographer, so check your licence before you reuse them. If a photo shows a person, they must be an adult who agreed to it being used. Don’t upload images of children, or sexual, violent, unlawful or infringing content. We may remove content and suspend accounts that break these rules.

4. AI-generated results

Results are made by AI models. They show what a space could look like: they aren’t a photograph of the property as it is, a measured drawing or a construction document. They can contain mistakes, so check every result against your original before you use it. Measurements, layouts, products and materials shown in results may not be accurate.

Don’t use Propviz to hide or misrepresent a property’s condition, size, features, views or surroundings: for example, by removing damage, permanent fixtures or neighbouring buildings, or by presenting a staged or redesigned image as the property as it is today.

Some results carry an invisible watermark or provenance data, added by our AI providers, that identifies them as AI-generated. Labelled downloads also carry a standard tag in their file data. Neither changes how the image looks. Please don’t remove them where the law requires them to stay.

The styles, furniture and presets in Propviz are shared by all our customers, so others may create similar results, and no one gets exclusive rights to a style. Depending on where you are, AI-generated images may not be protected by copyright; the rights in section 3 are the ones we give you. Don’t use Propviz to imitate a real person, to create fake reviews or endorsements, or to depict anyone as under 18.

5. Your responsibility

Propviz is a software tool. It makes images and videos from the photos and drawings you upload and the choices you make, and you decide whether, where and how to use them. We don’t publish your results or approve them for any use, and we aren’t the seller, agent, advertiser or publisher of any property or listing: you are. Any automated checks we run are there to keep the service working, not to confirm that a result is accurate or lawful.

You alone are responsible for what you upload, for the results you create, and for every use you make of them, including:

• making sure results are accurate and don’t mislead buyers, renters, clients or anyone else;
• having the rights and permissions for everything you upload;
• respecting other people’s rights, such as copyright, trademarks, privacy and likeness;
• following the laws and rules that apply wherever you publish, including real estate advertising and licensing rules, MLS and listing-portal rules, consumer protection law and AI disclosure rules.

Many of those rules ask for virtually staged, digitally altered or AI-generated images to be identified, and some ask you to make the original photo available. Deciding what applies to you, and making any disclosure it requires, is up to you. When you download, you can add a small label such as “Virtually staged” or “AI-generated”, and when you share a presentation you can include the original photos. These options are a convenience: we don’t give legal advice and can’t tell you what your use requires.

6. Reporting content

If you think something made or shared with Propviz is unlawful or infringes your rights, email hello@propviz.ai with a link to it, what you think is wrong and your contact details. We’ll review it promptly and may remove it.

7. Fair use

Don’t resell access to Propviz, scrape or overload it, try to reverse-engineer it, or use its results to train competing AI systems. We apply usage limits to keep the service reliable for everyone.

8. Changes

Propviz relies on third-party AI providers, so features, speed and styles can change over time. We’ll give reasonable notice before a change that materially reduces what a paid plan includes, and before important changes to these terms.

9. No warranties

Propviz and its results are provided “as is” and “as available”. As far as the law allows, we make no promises or warranties of any kind, express or implied. In particular, we don’t promise that Propviz will be uninterrupted or error-free, or that results will be accurate, unique, protected by copyright, free of any resemblance to real people, places or existing works, or suitable or lawful for any particular use.

10. Limitation of liability

As far as the law allows, we aren’t liable for any indirect or consequential loss; for lost profits, sales, commissions, revenue, goodwill or data; or for any loss that comes from how you use or publish results. Our total liability for all claims relating to Propviz is limited to what you paid us in the 12 months before the claim. These limits also protect our staff and suppliers.

11. Indemnity

As far as the law allows, you’ll defend and indemnify us, our staff and our suppliers against any claim, complaint, investigation, fine, penalty, damages, loss or cost, including legal fees, that arises from:

• what you upload;
• how you use, publish or distribute results, including a missing or incorrect disclosure;
• your breach of these terms; or
• your breach of any law or of anyone’s rights.

We may choose to handle a claim ourselves; if we do, you’ll cooperate with us and still cover the costs. You won’t settle a claim that involves us without our written agreement.

Nothing in these terms limits your rights as a consumer, or any liability that can’t be limited by law, such as liability for fraud or for death or personal injury caused by negligence.

12. Ending the agreement

You can close your account at any time by contacting us. We may suspend or close accounts that break these terms. After an account is closed we delete its uploads and results within 30 days, except records we must keep for legal or billing reasons. Sections 5 and 9 to 11 keep applying after the agreement ends.

13. Governing law and contact

These terms are governed by the laws of Ireland, and its courts decide any dispute. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live. Questions about these terms: hello@propviz.ai.
